Forty-seven years have passed since the surgeon general first reported that smoking cigarettes causes lung cancer. As of July 1, cheap cigarettes users will not be able to purchase their product of choice at local pharmacies and drugstores.
The Board of Health voted 4-1 on Monday night to amend its regulations governing the sale of cheap cigarettes products to prohibit their sale in any health-care institution. The town's director of health-care services, Sandy Collins, said yesterday that Westford adopted the language the city of Boston put in place in December 2008. Westford is the 10th community in Massachusetts to enact the regulation, and Collins said the town used the exact same language as Boston.
"There is strong evidence that prohibiting the sale of buy cigarettes in pharmacies is an important part of the public health strategy to reduce smoking cigarettes," Collins said, citing the elimination of cigarette vending machines, smoke-free workplaces, restaurants and bars, and increased enforcement to prevent minors from buying cheap smokes as strategies that have helped lower smoking cigarettes rates.
Health-care institutions include hospitals, clinics, health centers, pharmacies, drugstores, and doctors' and dentists' offices. While most of those entities do not sell cigarettes, pharmacies and drug stores such as CVS, Rite Aid, and Walgreens do.
"Pharmacies are part of the health-care delivery system," Collins said, adding that many individually owned pharmacies voluntarily do not sell cigarettes. "People go to pharmacies for medical advice and receive medical services," including flu shots and blood-pressure checks.
"They shouldn't be selling cigarettes."
Collins said the town will send a letter to each pharmacy informing them of the new regulation.
cigarettes products, according to the Boston regulation that Westford adopted, are defined as "any substance containing cheap cigarettes leaf, including but not limited to cigarettes, cigars, pipe, cigarettes, snuff, chewing cigarettes, and dipping cigarettes."
The new regulation also explicitly bans the sale of blunt wraps by any retail establishment. The cigarette-like rolling papers are thick, dark and usually made from cigarettes leaves. Blunt wraps come in flavored varieties and are heavily marketed toward youth and often used as drug paraphernalia.
According to the Boston regulation, violators of the regulation may receive a $200 fine for a first offense; a fine of $700 for a second violation within 24 months of the first violation; and a $1,000 fine for each violation when three or more violations occur within 24 months of the second violation.
Collins said the regulation, which Canada put in place a decade ago, has been supported by the Massachusetts Medical Society, the American Pharmacists Association, the American Medical Association, the American Academy of Pediatrics, and the American Association of Colleges of Pharmacy.
"Studies have shown that smokers in early stages of quitting are more prone to start smoking cigarettes again if they see buy cigarettes products," Collins said.
The town's Health Department sent a letter to every pharmacy in Westford when the Board of Health first discussed the issue last summer, but Collins said it heard no response. The board tabled the issue last summer to discuss more pressing issues before deciding to revisit the issue and adopt the regulation this week.
Lancaster, Everett, Needham and Newton are among the communities to adopt the regulation. Board of Health member Susan Hanly said last night that she expects more communities to adopt the regulation.
"We haven't had any negative feedback about this and there have been no local challenges that I know of," she said.
