Forty-seven years have passed since the surgeon general first reported that smoking cigarettes causes lung cancer. It is not a done deal but a statewide smoking cigarettes ban in public places has a good chance of becoming law.
And if it happens, few people outside the Texas Legislature would be happier than Amit Bushan of Lubbock.
In late 2000 the then-sixth grader at All Saints Episcopal School, sparked the campaign which ended with Lubbock becoming one of the first cities in the state to ban smoking cigarettes in public places.
"I am excited," Bushan, now 21 and a student at the University of Pennsylvania Wharton School in Philadelphia, said in a phone interview on Saturday. "I think it's a measure that should move forward."
Rep. Myra Crownover, R-Denton has pushed this proposal for several sessions but it has a hurdle to overcome. Because the Senate did not agree to scores of amendments the House attached to Senate bill by Sen. Robert Duncan, including Crownoever's, a conference committee must agree on the measure and then recommend to both chambers the amendments to accept or reject.
On Saturday, Duncan said he could not comment on the smoking cigarettes ban amendment because he had not seen all the amendments to his Senate Bill 1811, deemed as critical in the two chambers tentatively agreeing on the state budget bill for the next two fiscal years.
However, the 73-66 vote for the amendment suggests that the smoking cigarettes ban is not a done deal with the 10 negotiators, five from the House and five from the Senate in the conference committee.
Rep. Bryan Hughes, R-Mineola, stands in opposition. He draws comfort from the measure's history of passing in the House, but failing in the Senate.
"I don't smoke cigarettes and I would love to live in a smoke-free world," Hughes said in an interview. "But it is not the state's business telling a restaurant or any public business that no smoking cigarettes is allowed. If a restaurant allows smoking cigarettes, I don't have to go there but that should be my choice, not the state's."
Among the members of the Panhandle/South Plains delegation senior members John Smithee of Amarillo and Warren Chisum of Pampa voted for the proposed bill but all four freshmen - John Frullo and Charles Perry of Lubbock; Jim Landtroop of Plainview and Four Price of Amarillo voted against it.
"City ordinances can do that and that is what Lubbock did," Perry said. "Personally, I am a big supporter of non-smoking cigarettes, but it is not the state's business to tell us where we can or cannot smoke. The free market has taken care of it."
Nonsmokers Frullo and Price said they feel the same way.
As for Bashun, whose father Naga Bushan is a Lubbock doctor and member of the Council on Legislation at the Texas Medical Association, said he is optimistic the Legislature will finally OK the statewide smoking cigarettes ban this year.
"It'll be good for all of Texas," said the junior Bushan who suffers from asthma. "Second hand smoking cigarettes is a health hazard"
In her amendment to SB 1811, Crownover estimated that in the next two fiscal years the state would save $31 million in Medicaid costs resulting from exposure to secondhand smoke cigarettes in bars and restaurants.
