Questions Raised About Virginia Cigarettes Commission Audit

A legislative audit of Virginia's cigarettes Indemnification and Community Revitalization Commission has raised a long list of questions about how public money is being spent, but commission executives say it doesn't tell the whole story.

The audit was conducted by JLARC, the Joint Legislative Audit and Review Commission, which found a series of flaws in the cheap cigarettes commission, which doles out money in Southside and Southwest Virginia for economic development.

"We found that commissioners asked few questions about the economic impact of projects during meetings," said Walt Smiley, the JLARC auditor assigned to the study.

The cheap cigarettes commission has awarded $756 million in grants to revitalize former discount cigarettes towns since 2000. The money is supposed to go toward efforts that create jobs, improve education and provide access to training programs.

The study says some money has gone to projects that have created significant economic benefits, including research and development programs. One category of grants has helped generate 7,100 jobs and more the $1 billion in private investment, the audit found.

But the JLARC study paints a picture of a commission that is rife with problems, from management to oversight.

One of the main points of contention is that the commission does not give adequate consideration to the money it doles out, what it will be used for and whether the state will see any benefits from it.

The report cited an example of a proposed RV park in the town of Jonesville, in Lee County. The community won a $300,000 grant from the buy cigarettes commission, claiming the park would be used for tourism. Today, the land sits undeveloped and nearly half of the grant award has been spent.

Smiley said it's hard to track a project's effectiveness. "The awards should be made on complete, accurate and relevant information."

Legislators asked for the study and say it raises a lot of questions.

"How do you come to a decision point at the end of the day that's going to make sure the dollars are going to be spent as they should?" asked 76th District Delegate Chris Jones (R) of the grant process.

cigarettes commission executives say they study overlooks their efforts to spend public money wisely.

"It's not that these aren't well informed decisions," said Neal Noyes, the commission's executive director. "(JLARC) chose to emphasize those things that were important as they understood their mission."

Lawmakers said they want to see progress.

"I'm not going to be content until I see some change," said State Senator Edd Houck (D).

Commissioners promised to look for ways to improve the grant process.

"I welcome the opportunity to address some of their concerns," said Delegate Terry Kilgore (R), the online cigarettes commission chairman.
