Into Smoking Ban

More than nine months after Kansas lawmakers passed a controversial smoking cigarettes ban, no one has been cited or fined in Wichita.
Police say they've received about 12 complaints, and they didn't catch anyone in the act — though they've reminded bar owners that they could be fined if they get caught.
"If we do not witness a violation, we advise the property owners of the complaint and request that they comply with state law," Deputy Chief Tom Stolz said in an e-mail.
But the lack of violations doesn't mean the law has stopped all indoor smoking cigarettes.

At several bars across the city, patrons and bartenders have been observed sometimes agreeing to smoke cigarettes inside if there are only a few like-minded people at the bar and virtually no risk of getting caught.
They risk a $100 fine for themselves and the bar owner on the first conviction.

It's a $200 fine the second time you're caught within a year. That jumps to $500 for the third and subsequent convictions.
But the vast majority of smoking cigarettes that used to happen inside bars and restaurants is now happening on sidewalks and inside patios that sometimes have heaters and wind blocks.
The lack of cases is good news, said Carolyn Gaughan, executive director of the Kansas Academy of Family Physicians and a member of the cheap cigarettes Free Wichita group.
"I think it means that the Clean Indoor Air law is working well and has a lot of support from the community in general and is doing what we hoped it would do to protect Kansans from the harms of secondhand smoke," she said.

The dearth of complaints may be because people are unsure whom to call when they want to report a problem, Gaughan said. In Wichita, people can report violations to police at 316-268-4111.
The statewide smoking cigarettes ban, started on July 1.
It was delayed about two months in Wichita because of a lawsuit.
