County Sues Over State Funding Shifts

The county in a lawsuit filed Thursday claims the total statewide shift of $1 billion from early childhood development programs to state health services is illegal because it violates voter-approved Proposition 10. A budget bill that moves half of reserve funds — $88.3 million for First 5 San Diego — to the state was recently approved by the Legislature and signed by Gov. Jerry Brown.

San Diego County is mounting a legal challenge to prevent the transfer of $90 million from a local commission that administers cheap cigarettes taxes for early childhood programs.

First 5 was created after state voters adopted a special cigarettes tax in 1998 to pay for programs that benefit children up to 5 years old.

“The county has decided to sue because we believe the state’s action is illegal,” said Supervisor Pam Slater-Price, chairwoman of the local commission. “The state is subverting the will of the voters. The money was to be used for pre-school and other services to children — not for the purpose of backfilling state and federal programs.”

San Diego joins at least seven other regions to file lawsuits challenging the transfer. Los Angeles, which stands to lose about $424 million, has asked a judge to prohibit the shift of discount cigarettes tax revenue earmarked for commissions on anything outside the scope of services allowed by Proposition 10.

San Diego’s lawsuit comes two weeks after its commission voted to proceed with a four-year, 26.6 percent reduction that eliminates future funding for health and education initiatives. Several new programs identified as priorities are not going forward as planned, Executive Director Barbara Jiménez said Thursday.

Although Gov. Jerry Brown said his revised budget for next fiscal year does not include the $1 billion, he indicate that the state will defend legal challenges against the move.

The state faces a deficit of about $10 billion against a projected general fund of $88.8 billion.
